Terms and conditions
OFFICIAL RULES AND REGULATIONS
The Mount Allison University 25 in 2025 Giveaway (the “Giveaway”) is organized by Mount Allison University (the “Sponsor”).
This Giveaway is in no way sponsored, enforced or administered by, or associated with Instagram, Facebook, Snapchat or Tik Tok. Participants acknowledge that by entering this Giveaway they are providing their information to the sponsor as described below and not to Instagram, Facebook, Snapchat or Tik Tok.
DEFINITIONS:
(a) “Entrant” means a person for whom an entry is submitted in the Giveaway;
(b) “First-year Student” means a student in their first-year of study at Mount Allison University including mature students and those who have deferred admission from the 2024-25 academic year. This excludes transfer students.
(c) “Prize” means any of the prizes listed under section 8.1 and the Grand Prize;
(d) “Released Parties” means any persons, respective agents, employees, directors, successors, and assigns that participate in the organization, planning, and operation of the Giveaway, including the Sponsor; and
(e) “Winner(s)” means the student(s) selected through a random draw on or about March 14th, 2025, who has won a Prize.
1. ELIGIBILITY
1.1 No purchase is necessary.
1.2 To be eligible for the Giveaway, Entrants must:
(a) Be a Canadian citizen or permanent resident (excluding Quebec);
(b) Be a prospective first-year student who will be attending Mount Allison University full-time for the 2025-2026 academic year, starting September 2025;
1.3 Entries are cumulative, meaning they are eligible for a daily Prize if the criteria are met.
1.4 Employees of Mount Allison University, its advertising and promotional agencies, and members of their respective immediate families (defined as parents, children, siblings, and spouse) or households are not eligible to win.
1.5 The Sponsor shall have the right at any time, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to Sponsor – including, without limitation, government issued photo identification) to participate in the Giveaway. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification from the Giveaway.
1.6 The sole determinant of the time for the purpose of a valid entry in this Giveaway will be the Sponsor. All personal and other information requested by and supplied to the Sponsor for the purpose of the Giveaway must be truthful, complete, accurate and in no way misleading. The Sponsor reserves the right, in their sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
1.7 The Sponsor shall have the right at any time, in its sole and absolute discretion, to require proof of enrollment and/or proof of admission. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification from the Giveaway. The sole determinant of the time for the purpose of a valid entry in this Giveaway will be the Sponsor. All personal and other information requested by and supplied to the Sponsor for the purpose of the Giveaway must be truthful, complete, accurate and in no way misleading. The Sponsor reserves the right, in their sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
2. GIVEAWAY PERIOD:
The Giveaway begins at 8:00 a.m. (Atlantic Time) on January 27th, 2025, and ends at 11:59 p.m. (Atlantic Time) on March 1, 2025 (the “Giveaway Period”), at which time the Giveaway will be closed and no further entries shall be accepted.
3. WINNER SELECTION:
Winners will be selected in a random draw on or about March 14th, 2025 at 10:00 a.m. at the Wallace McCain Student Centre by the Admissions Office (62 York St., Sackville, New Brunswick) from all entries received on or before the closing date, including those who had been submitted prior to the Giveaway start date. There shall be one Winner for each Prize.
4. HOW TO ENTER:
To enter the Giveaway, eligible Entrants must submit a completed application for admission for the 2025-2026 academic year on Mount Allison University’s website; and confirm compliance with the contest rules and regulations.
Entrants may submit a 500-word essay on the topic of “The top three reasons I want to attend Mount Allison University” by email to 25in2025@mta.ca in order to receive a code waiving the fee associated with submitting an application for admission at Mount Allison University.
5. NO PURCHASE NECESSARY.
No purchase is necessary to enter the Giveaway. Giveaway participation is free. Starting January 27, 2025, the Giveaway will be promoted online at mta.ca, on Mount Allison University’s social media accounts, in various print, digital and media ads.
6. ENTRY SUBMISSION GUIDELINES
The Sponsor reserves the right to reject any entry it determines violates these Rules, in its sole discretion. All entries to the Giveaway become the property of the Sponsor. Entrants who have registered through fraudulent means or have provided false or misleading information will be disqualified. An entry which, in the sole discretion of the Sponsor, fails to comply in whole or in part with any of these guidelines, these Rules, or the spirit thereof, may be disqualified, and the Entrants shall be ineligible to win a Prize.
7. ADDITIONAL ENTRY RULES
7.1 There is one entry per participant. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to use multiple names, multiple identities, multiple email addresses, any automated, macro, script, robotic or other system(s) or program(s) and/or any other means not in keeping with the Sponsor’s interpretation of the letter and spirit of these Rules to enter or otherwise participate in or to disrupt this Giveaway; then they may be disqualified from the Giveaway in the sole and absolute discretion of the Sponsor (and, if disqualified, will have his/her/their entry/entries deemed null and void). Entries generated by automated scripts or other automated means are void. Entries with typographical errors, inaccuracies, or irregularities are not eligible.
7.2 The Released Parties are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible Entries and/or other information (all of which is void).
8. PRIZES
8.1 There are four prizes available to be won. These prizes consist of:
(a) MacBook valued up to $2,500 CAD (“Prize 1”);
(b) Free books for the 2025-2026 academic year, over two academic terms based on annual estimate, valued at a maximum of $2,500 CAD (“Prize 2”);
(c) Free residence for the 2025-2026 academic year ($9,500 CAD maximum value), over two academic terms, which includes a single room in residence (“Prize 4”). The availability of the residence room is subject to availability and the Winner may be assigned to an alternative residence if the selected residence is fully booked. The Winner of this prize is responsible for paying for the mandatory all-access meal plan at their own expense. The meal plan cost is not included in this prize and must be covered by the Winner; and
(d) Free domestic tuition for the 2025-2026 academic year, over two academic terms (value of $11,000 CAD) (“Prize 3”).
8.2 There is one grand prize available to be won (“Grand Prize”). The Grand Prize consists of:
(a) Free Domestic Tuition, Free Residence, and Free Meal Plan for the 2025-2026 academic year, as outlined above, over two academic terms (value of $26,500 CAD).
8.3 All other student fees, costs, or expenses not expressly mentioned herein in connection with the Prize, including but not limited to insurance, transportation, student union fees, media fees, technology fees, and optional fees (such as student health insurance, which may be opted out of with proof of alternate coverage, dental insurance, and any other fees payable to Mount Allison in connection with the Prize Winner's program of study), are not included and are the responsibility of the Winner.
8.4 The Winner is under no obligation to remain enrolled at Mount Allison University following the 2025-2026 academic year to which the Prize applies.
8.5 Each Prize shall be announced daily, starting on January 27th, 2025 and ending on January 31st, 2025, as follows:
(a) Prize #1 shall be disclosed on January 27th, 2025;
(b) Prize #2 shall be disclosed on January 28th, 2025;
(c) Prize #3 shall be disclosed on January 29th, 2025;
(d) Prize #4 shall be disclosed on January 30th, 2025; and
(e) The Grand Prize shall be disclosed on January 31st, 2025.
8.6 Without limiting the generality of the foregoing, the following general conditions apply to each Prize:
(a) A Prize must be accepted as awarded and is not transferable, assignable and/or or convertible to cash (except as may be specifically permitted by the Sponsor in its sole and absolute discretion);
(b) No substitutions are permitted except at the Sponsor’s discretion;
(c) The costs of everything not expressly and specifically stated above as included in the Prize are the sole and absolute responsibility of the Winner of such Prize; and
(d) The Sponsor reserves the right at any time to:
(i) place reasonable restrictions on the availability or use of the Prize or any component thereof; and/or
(ii) substitute the Prize or a component thereof for any reason with a Prize or Prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award.
8.7 In the case that a Winner is unable or unwilling to accept a Prize as offered, then the Prize shall be awarded to the next randomly drawn Winner as determined by the Sponsor.
8.8 In the case that a Winner drops out of Mount Allison University or fails to meet the enrollment requirements, including, but not limited to withdrawing from Mount Allison University during or after the first academic term (Fall 2025), then:
(a) For Prize 2, Prize 3, Prize 4, and the Grand Prize, the Winner shall be entitled solely to the Prize for the first academic term (Fall 2025), thereby forfeiting any remaining portion of the Prize that would have been awarded during the second academic term (Fall 2026); and
(b) For Prize 1, the Winner’s entitlement to Prize 1 remains unchanged and unaffected.
8.9 None of the Released Parties makes any representation or offers any warranty, express or implied, as to the quality or fitness of the Prizes awarded in connection with the Giveaway. To the fullest extent permitted by applicable law, the Winner understands and acknowledges that he, she, or they may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the other Released Parties should the Prize fail to be fit for its purpose or is in any way unsatisfactory. For greater certainty and the avoidance of any doubt, by accepting a Prize, each Winner agrees to waive all recourse against the Sponsor and all of the other Released Parties if such Prize or a component thereof does not prove satisfactory, either in whole or in part.
9. NOTIFICATION
9.1 The Winner will be notified via email.
9.2 To claim a Prize, a Winner must do the following:
(a) Correctly answer a mathematical skill-testing question, where failure to correctly answer the skill-testing question will result in disqualification and the forfeiture of his or her interest in the Prize;
(b) Sign a declaration and release form, confirming compliance with the Giveaway rules, and accepting the Prize as awarded;
(c) Hold a full offer of admission from the University;
(d) Pay the non-refundable registration deposit ($100) by 11:59 p.m. Atlantic Standard Time (AST) by March 31th, 2025.
9.3 If the Winner is under the age of majority, a parent or guardian must also sign the declaration and release form.
9.4 Failure by the Winner (and, where applicable, his or her parent or guardian) to complete, sign, and return any of the documents mentioned in subsection 9.2 within 14 business days after notification is sent to the Winner may result in forfeiture of the Prize, in the sole discretion of the Sponsor.
9.5 In the event of forfeiture for the reasons outlined in Section 9.4, the Sponsor reserves the right to reallocate any of the Prizes to the next randomly selected Winner.
9.6 In order to receive the Prize, each Winner must register for courses and attend Mount Allison University starting in Fall 2025. Prizes will be awarded directly to student accounts after the official drop date for courses in the Fall 2025 term or directly in gift certificate to Bookstore or as product. No cash value is given.
10. RESPONSIBILITY
The Released Parties are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason, of any aspect of the Prize. No compensation whatsoever will be provided to the Winner or any other person or entity in the event of such delay, cancellation or other event contemplated herein.
11. INDEMNIFICATION
By entering this Giveaway, each Entrant releases and holds each of the Released Parties harmless from any and all liability for any injuries, loss or damage of any kind to the Entrant, Released Party or any other person or entity, including, without limitation, personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in this Giveaway, any breach of these Rules, or in any Prize-related activity. Each Entrant agrees to fully indemnify the Released Parties from any and all claims by third parties relating to the Giveaway, without limitation.
12. LIMITATION OF LIABILITY
12.1 The Released Parties assume no responsibility or liability whatsoever for lost, late, misdirected or incomplete Entries, requests, notifications, responses, replies requests or any Release, or for any telephone, hardware, software or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry. The Released Parties are not responsible for any incorrect or inaccurate information, whether caused by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error which may occur in the administration of the Giveaway. The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries, requests, and/or other information. The Released Parties are not responsible for any problems, failures or technical malfunction of any telephone network or lines on account of technical problems or otherwise. The Released Parties are not responsible for anyone being incorrectly and/or mistakenly identified as a Winner. The Released Parties are not responsible for any injury or damage caused to any Entrant, person or entity relating to or resulting from participating or attempting to participate in the Giveaway.
12.2 Entrant assumes liability for injuries caused or claimed to be caused by participating in the Giveaway, or by the acceptance, possession, use of, or failure to receive the Prize or any portion thereof. The Released Parties assume no responsibility or liability in the event that the Giveaway cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsors, such as infection by tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this Giveaway.
13. CONDUCT
By entering this Giveaway, each Entrant agrees to be bound by these Rules, which will be posted online at mta.ca throughout the Giveaway Period. Each Entrant further agrees to be bound by the decisions of the Giveaway Sponsor, which shall be final and binding without right of appeal in all respects. The Sponsor reserves the right, in its sole and absolute discretion, to disqualify any Entrant found to be: (i) violating the Rules; (ii) tampering or attempting to tamper with the entry process or the operation of the Giveaway; and/or (iii) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE GIVEAWAY SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE GIVEWAY SPONSOR AT ANY TIME.
14. PRIVACY & USE OF PERSONAL INFORMATION
14.1 By participating in the Giveaway, the Entrant:
(a) grants to the Sponsor the right to use his/her/their name, mailing address, telephone number, and email address (the “Personal Information”) for the purpose of administering the Giveaway, including, but not limited to, contacting the Winners; and
(b) acknowledges that the Sponsor may disclose his/her Personal Information to third-party agents and service providers of the Sponsor in connection with any of the activities listed in (a) above.
14.2 The Sponsor and any third-party agents of the Sponsor will use the Entrant’s Personal Information only for identified purposes and protect the Entrant’s Personal Information in a manner that is consistent with the applicable legislation. This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their Personal Information.
15. INTELLECTUAL PROPERTY
All intellectual property, including but not limited to trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans, and representations are owned by the Sponsor and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
16. TERMINATION AND AMENDMENTS
16.1 The Sponsor reserves the right to withdraw, amend or suspend this Giveaway (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Giveaway as contemplated by these Rules, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever.
16.2 Further, the Sponsor reserves the right to cancel, amend or suspend this Giveaway, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.
16.3 Further, the Giveaway reserves the right to adjust any of the dates, timeframes and/or other Giveaway mechanics stipulated in these Rules, to the extent deemed necessary by the Sponsor, for purposes of verifying compliance by any Entrant, entry and/or other information with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Giveaway as contemplated in these Rules, or for any other reason.
17. PRIORITY
In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Giveaway-related materials, including, but not limited to television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law.
18. GOVERNING LAW
To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, Sponsor or any of the other the Released Parties in connection with the Giveaway shall be governed by and construed in accordance with the domestic laws of the Province of New Brunswick and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
